I currently have H1b that will expire in May 2016, I am in process to file Green card. Now only PERM
Process is underway.
1: What will be my status after TPS expirer in Dec 2016? I heard that it will revert back to previous status (in my case H1B).
Can't find legitimate link in this regard. I
2: Since I already have H1b that will allow me to work for current employer. Can I only file I-821 and still
be able to use H1B to work ? OR do I have to file I-765 to get Emp Auth.

b) If you do not need TPS EAD than you don't have to apply for TPS EAD. But you still need to fill out I-765. NOTE: If you do not want an EAD, do not check any of the three boxes at the top of Form I-765 where it states “I am applying for:”; leave all three boxes blank. Only check one of these boxes if you want an EAD (and then look to the above chart for proper fee).
